General Terms and Conditions:

1. Applicability:

 

1.1 These general terms and conditions apply to all products and services that are delivered to customers by Art Journey.

 1.2 These general terms and conditions are part of any and all agreements which Art Journey is part of, unless otherwise agreed by both parties.

 1.3 Art Journey does not consider itself bound to general or specific conditions which the customer has declared applicable. These non applicable conditions are hereby rejected, with reference to Art Journey's general terms and conditions.

 1.4 Any terms and conditions stated by the customer are only applicable when these terms and conditions are accepted explicitly and in writing by Art Journey. Furthermore Art Journey's general terms and conditions will prevail in conflict.

 2. Prices and Payments:

 2.1 All prices stated on this site are in euro’s including VAT, unless otherwise stated.

 2.2 Unless otherwise agreed all payments will occur by means of payment in advance. These payments in advance will occur by means of a transfer to the bank account of Art Journey.

2.3 Goods shall only be sent to the customer by Art Journey when the total purchase price has been transferred to the bank account of Art Journey.

 2.4 The minimum order value is € 10.00, Art Journey reserves the right to reject any and all orders that do not comply with the minimum order value as stated above.

 2.5 The customer hereby declares to be aware of the fact that items which are not in stock have to be ordered by Art Journey, and that this does not create grounds to refuse or cancel the order by the customer. Deviation from the afore mentioned can only be made so after explicit written permission from Art Journey.

 

2.6 The customer and Art Journey agree that the electronic communication will result in a valid and legally binding agreement. In particular, the lack of a signature does not affect the binding effect of placing an order.

 2.7 The customer is responsible for the accuracy of the stated information regarding personalia and shipping. If you are under 18, you may only order with the consent of a parent and/or guardian.

 2.8 Art Journey reserves the right to; refuse services and customers, to remove customers from its database, to edit or delete content on this site and to cancel orders.

 3. Shipping and transportation risk:

 3.1 The dispatch of goods shall occur, unless agreed otherwise in writing, at the risk and expense of the customer. Furthermore Art Journey reserves the right to determine the shipping method.

 3.2 Art Journey is entitled to partial delivery, in compliance with article 2.5 of these terms and conditions. Each partial delivery shall be regarded as an individual delivery.

3.3 It is the customers responsibility to immediately inspect the received products upon delivery for shipping damage and/or defects. Furthermore if there prove to be shipping damages and/or defects the customer is required to report this to Art Journey within 24 hours.

3.4 Art Journey uses a standard rate for delivery to the Netherlands, these rates are the following:

Standard "mailbox sized" delivery :                 € 2.50

Parcel delivery:                                                   € 6.20

Art Journey emphasis that these rates only apply to shipments to the Netherlands, orders which require shipment to other countries and/or regions are likely to have shipping rates/costs that deviate from the ones mentioned above. In light of these deviating shipping rates/costs Art Journey reserves the right to charge a higher shipping cost/rate.

4. Delivery time:

 4.1 After payment the goods, if in stock, will be sent to the customer as soon as possible. And at most within 7 business days. Art Journey reserves the right to deviate from this article do to force majeure or other obstructing circumstances.

4.2 When goods are not in stock they will be sent once they have been delivered to Art Journey. The customer will receive a phone or e-mail message to inform them of this delay, but only if a phone number or e-mail address is known.

4.3 The term which arises from article 4.1 is not intended to create a state of negligent omission to prejudice Art Journey. Exceeding the afore mentioned term within reasonable limits, for any reason whatsoever, does not give the customer the right to refuse receipt of the goods or demand an indemnity from Art Journey.

5. Returns

5.1 Goods may be returned within 14 days after delivery.

5.2 Shipping costs, for the return of delivered goods, shall be borne by the customer unless otherwise agreed.

5.3 When wrong, i.e. not ordered, goods were shipped, the return costs will be reimbursed by Art Journey. Provided that an agreement has been reached about the matter in advance. Communication regarding this reimbursement matter shall occur by telephone or e-mail.

5.4 Goods which are returned should be in perfect condition and in original packaging, the customer bears responsibility for this matter. This responsibility also extends to any and all damages which are a result of return shipping.

5.5 After returning the goods, the full purchase price of the goods shall be credited to the bank account as stated by the customer. Art Journey reserves the right to deduct the costs of damages from the original full purchase price if this is deemed necessary by Art Journey.

6. Copyright

6.1 All content on this site, including; text, logos, buttons, icons and software, is owned by Art Journey or its suppliers, and is protected by Dutch and international law. Furthermore the compilation of all content on this site is the exclusive property of Art Journey, and is protected by Dutch and international copyright law.

 

7. Applicable law(s) and disputes

7.1 Agreements between Art Journey and its customers are governed by Dutch law, unless otherwise agreed.
